These Terms of Service apply to the Beyond Italian 12-Week Program.
By purchasing, booking or participating in the Program, you (“you”, “your” or “Participant”) confirm that you have read and accepted these Terms.
The Beyond Italian 12-Week Program is a personalised online Italian language and cultural coaching program.
Unless otherwise stated on the sales or checkout page, the Program includes:
All twelve sessions must be completed within three calendar months from the date of your first session.
The Program does not include flights, accommodation, travel bookings, retreats, external events, third-party subscriptions, textbooks or additional coaching sessions unless expressly stated in writing.
You must be at least 18 years old to purchase the Program.
A person under 18 may participate only where a parent or legal guardian purchases the Program, approves their participation and accepts these Terms on their behalf.
You are responsible for providing accurate information about your language level, goals, availability and any relevant learning requirements.
The total Program price will be displayed on the sales or checkout page before payment is completed.
The full price must be paid upfront before the Program begins. Your place and coach match are not confirmed until payment has been successfully received.
The Program is a fixed 12-week service. It is not a monthly subscription and does not renew automatically.
Unless expressly offered at checkout or agreed in writing, instalment payments are not available.
The total amount payable, including any GST, VAT or similar tax that Beyond Italian is legally required to collect, will be shown before payment is completed.
You are responsible for any currency-conversion charges, international transaction charges or other fees applied by your bank or payment provider.
Payments may be processed by a third-party provider such as PayPal or Stripe. Your use of that provider may also be subject to its own terms and privacy policy.
Beyond Italian may offer an introductory call before or after purchase to understand your level, goals, interests and availability.
We will use this information to select a suitable coach. Coach matching is based on professional judgement, compatibility and availability.
Unless expressly confirmed in writing, purchasing the Program does not guarantee access to a particular named coach.
After your coach has been assigned, you may request one coach rematch where there is a genuine compatibility issue. We will make reasonable efforts to provide another suitable coach, subject to availability.
A preference for a different personality, accent, teaching approach or schedule does not automatically create a right to a refund.
Your Program begins on the date of your first coaching session.
Unless otherwise agreed in writing, the first session must take place within 30 days of purchase.
You are encouraged to agree on a regular weekly session time with your coach. All bookings remain subject to coach availability.
Failure to arrange or attend your first session does not extend the Program period unless Beyond Italian agrees otherwise in writing.
Individual sessions cannot be cancelled for a refund or credit.
You may reschedule a session by giving at least 12 hours' notice before its scheduled start time.
Rescheduling requests must be made by email to infobeyonditalian@gmail.com or through the booking link provided by your coach.
Where at least 12 hours' notice is provided, we will make reasonable efforts to arrange another suitable time.
All rescheduled sessions remain subject to coach availability and must be completed within the original three-month Program period.
Repeated rescheduling may affect our ability to offer your preferred coach or session time.
A rescheduling request received less than 12 hours before the scheduled start time will be treated as a late rescheduling request, and the session will normally be considered used.
If you request to reschedule less than 12 hours before the scheduled start time, the session will normally be treated as used and will not be refunded, credited or rescheduled.
If you do not attend a session and have not provided notice, the session will be treated as used.
If you arrive late, the session will still end at the originally scheduled time. Your coach is not required to extend the session beyond the scheduled 50 minutes.
If you are more than 15 minutes late without contacting your coach, the session may be treated as a no-show.
These rules exist to be fair to our coaches, whose time is reserved exclusively for you and cannot be used elsewhere once a session is booked.
Beyond Italian may make an exception for a documented emergency, serious illness or another exceptional circumstance outside your reasonable control. Any exception is considered individually and is not guaranteed.
If your coach is unable to attend a scheduled session, the session will not be treated as used.
Beyond Italian will offer one of the following:
A session affected by a coach cancellation must still be completed within the Program period unless Beyond Italian confirms an extension in writing.
If we cannot provide the affected session within a reasonable period, you may be entitled to a proportionate refund for that session.
The Program begins on the date of your first coaching session and remains valid for three calendar months.
All twelve sessions, including any sessions rescheduled by you, must be completed before the end of this three-month period.
Any unused sessions remaining at the end of the Program period will expire.
Expired sessions cannot be refunded, credited, transferred or carried forward.
It is your responsibility to book and attend your sessions with sufficient time to complete all twelve sessions before the expiry date.
Coach availability cannot be guaranteed for sessions left until the final weeks of the Program.
Where serious illness, injury, bereavement or another significant circumstance prevents you from continuing, you may request an extension. Supporting information may be requested where reasonable.
Any extension is considered individually and must be confirmed by Beyond Italian in writing.
The Program cannot normally be paused because all twelve sessions must be completed within three calendar months.
In exceptional circumstances, including serious illness, injury or bereavement, Beyond Italian may approve a temporary pause or extension in writing.
Travel, work commitments, holidays, changes in availability or failure to book sessions do not automatically entitle you to a pause or extension.
You may stop participating in the Program at any time by notifying Beyond Italian in writing.
Stopping your participation does not cancel the purchase and does not entitle you to a refund, credit or transfer for unused sessions.
All unused sessions will expire at the end of the original three-month Program period.
This section does not limit any rights or remedies that cannot legally be excluded under applicable consumer law.
The Program is a fixed 12-week service for which coaching time, coach availability and resources are reserved in advance.
Once your first coaching session has taken place, refunds are not available for:
Before the first session takes place, any request to withdraw will be considered according to the circumstances, the work already completed and applicable consumer law.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded.
If there is a problem with the Program, you should contact Beyond Italian promptly and explain what has happened.
Depending on the nature of the problem, an appropriate remedy may include:
A refund will not normally be provided solely because you changed your mind, became unavailable, failed to attend, did not complete the Program or expected a particular language outcome.
Beyond Italian may replace your coach where reasonably necessary because of illness, availability, travel, personal circumstances, performance concerns or the ending of the coach's relationship with Beyond Italian.
We will make reasonable efforts to select a replacement coach whose experience, teaching style and availability suit your needs.
A reasonable coach substitution does not by itself entitle you to cancel the Program or receive a full refund.
If we cannot provide a suitable replacement within a reasonable period, you may request a proportionate refund for any sessions that cannot be delivered.
Beyond Italian provides coaching, guidance and educational support.
Individual results vary according to attendance, participation, previous knowledge, practice, motivation and personal circumstances.
We do not guarantee that you will reach fluency, pass an examination, obtain employment, qualify for citizenship or residency, or achieve a specific language level within 12 weeks.
Statements about confidence, progress, cultural understanding or conversational ability describe the aims of the Program and are not guarantees of a particular result.
Coaches may share personal experiences, cultural observations, local recommendations and general information about travelling or living in Italy.
This information is educational and personal in nature. It is not professional legal, immigration, financial, medical, tax, relocation or travel-agent advice.
You are responsible for independently checking visas, entry requirements, insurance, bookings, laws, prices, opening times, safety conditions and other travel information before making decisions.
Recommendations reflect personal knowledge and may change over time. Beyond Italian does not guarantee the availability, quality or suitability of third-party venues, services or experiences.
Sessions will normally take place through an agreed online platform.
You are responsible for having:
If a session cannot proceed because of a technical problem caused by Beyond Italian or the coach, it will be rescheduled or credited.
If a session cannot proceed because of your equipment, internet connection or environment, the session may be treated as used after reasonable attempts have been made to continue.
Neither party is responsible for brief interruptions outside their reasonable control. The parties should act reasonably to complete or reschedule a materially disrupted session.
You agree to communicate respectfully with coaches, staff and other participants.
You must not:
Serious or repeated misconduct may result in suspension or termination of your participation.
Where the Program is terminated because of serious misconduct, you will not normally receive a refund for services already delivered or losses reasonably caused by that misconduct.
Any refund for unused services will be determined consistently with applicable law.
Your coach may communicate with you between sessions for reasonable scheduling, preparation or learning-related purposes.
Unless expressly included in the Program, between-session messaging does not provide unlimited tutoring, immediate replies or continuous access to your coach.
Coaches are not emergency contacts and are not required to respond outside their reasonable working hours.
You must use the approved communication channels and respect the coach's privacy and personal boundaries.
All original Beyond Italian materials, including lesson materials, exercises, written guides, videos, recordings, branding and website content, remain the property of Beyond Italian or the relevant creator.
You receive a personal, limited and non-transferable right to use Program materials for your own learning.
You must not copy, publish, distribute, sell, license, upload or commercially exploit the materials without prior written permission.
You retain ownership of original material you create and provide during the Program.
Sessions are not recorded by default.
Neither you nor the coach may record a session without the other party's clear prior consent.
Where a recording is agreed, the intended use, access and retention of that recording should be confirmed before recording begins.
Beyond Italian collects and uses personal information to process payments, match you with a coach, administer bookings, deliver the Program and communicate with you.
Personal information will be handled in accordance with the Beyond Italian Privacy Policy and applicable privacy laws.
You agree that information reasonably necessary to provide the Program may be shared with your assigned coach and relevant service providers.
We may suspend or terminate your participation where:
Where reasonably possible, we will explain the issue and give you an opportunity to respond before termination.
Termination does not affect rights or obligations that arose before termination.
Beyond Italian is not responsible for delay or failure caused by events outside our reasonable control, including natural disasters, serious illness, widespread internet outages, government restrictions, war, civil unrest or failure of essential third-party services.
Where such an event materially affects the Program, we will make reasonable efforts to reschedule sessions, extend the completion period, provide a substitute coach or offer another suitable remedy.
We may make reasonable administrative or operational changes to the Program where necessary.
We will not materially reduce the core twelve-session service you purchased without offering an appropriate alternative or remedy.
Any material change affecting your existing purchase will be communicated to you.
The Terms that apply to your purchase are the version accepted when you paid for the Program.
We may update these Terms for future purchases. Updated Terms will be published with a new effective date.
We will not retrospectively impose a material disadvantage on an existing Participant without consent unless the change is required by law.
Questions, concerns and complaints should first be sent to infobeyonditalian@gmail.com.
Please include your name, coach, Program start date and a clear description of the issue.
We will review the complaint and aim to respond within a reasonable time.
The parties agree to attempt to resolve disputes in good faith before beginning formal legal proceedings, except where urgent action is required or a consumer has a legal right to pursue another process.
These Terms are governed by the laws of [STATE OR TERRITORY], Australia, subject to any mandatory consumer protections that apply to you.
The parties submit to the non-exclusive jurisdiction of the courts and tribunals of that State or Territory.
Nothing in this section prevents you from exercising rights available under mandatory consumer laws in your country of residence.
If part of these Terms is found to be unlawful, invalid or unenforceable, that part will be removed or limited to the minimum extent necessary.
The remaining Terms will continue to apply.
